Caveat loans for personal use: understand the referral pathway before risking your property.

Basic Finance does not provide, recommend or assess regulated consumer credit. Where appropriate, we may—with your consent—introduce your enquiry to a separate provider that holds the required Australian credit licence or is otherwise legally authorised to consider it.

The essential distinction

“Caveat loan” describes a security concept—not permission to bypass consumer-credit rules.

An individual may own valuable property and still need an appropriate regulated-credit pathway when borrowing for personal, domestic or household purposes. Certain residential investment borrowing can also fall within regulated credit. The real purpose, borrower, property and transaction must be assessed accurately.

Basic Finance’s role

We may conduct an initial enquiry review and, with your consent, introduce you to a separate appropriately licensed or otherwise authorised provider. We do not decide eligibility, recommend regulated credit or promise an outcome.

Any referral benefit or commission will be disclosed before your contact details are shared.

The receiving provider’s role

The provider conducts its own assessment, explains its process, decides what information and property evidence it requires, and determines whether any facility is suitable and available.

An introduction is not an application approval, loan offer or commitment to settle.

Referral pathway

Four clear stages—from enquiry to an independent provider decision.

State the real purpose

Explain exactly what the funds will pay for, who will borrow, which property may be offered and whether it is owner-occupied, investment or another type. Do not relabel personal spending as business borrowing.

Initial pathway review

Basic Finance considers whether the enquiry may be suitable for introduction. This is a referral decision only—not credit assessment, advice or approval.

Consent and disclosure

Before sharing contact details, we explain the proposed introduction and disclose any referral benefit we may receive. Your details are shared only with your consent.

Separate provider assessment

The receiving provider performs its own enquiries, checks, valuation or property assessment, legal process and credit decision. Its criteria, costs, timing and documentation control.

Who may enquire

Personal, household and individual investment circumstances require the correct pathway.

Personal or household purpose

A property owner may need funds for a legitimate personal expense, refinance, family requirement or another private purpose. Equity alone does not establish eligibility or affordability.

Residential investment

Investment lending is not automatically outside consumer-credit regulation. Describe the asset and use of funds precisely so the receiving provider can determine the applicable pathway.

Individual borrower

Borrowing in a person’s name does not automatically make a loan consumer or commercial. Structure and purpose both matter, and the legal position must be assessed case by case.

Business-purpose enquiries remain separate. Basic Finance directly assists with eligible business-purpose finance. Corporate-borrower investment scenarios may also be considered where appropriate, including cases where the corporate borrower is on title, subject to lender and legal assessment.
Evidence and assessment

No-credit-check or no-valuation claims should never be assumed.

A provider may use different methods to assess a transaction, but “caveat loan” does not mean no checks, no documents, no valuation, guaranteed approval or immediate settlement.

Information commonly considered

  • Identity, borrower structure and actual loan purpose
  • Property address, ownership, existing mortgages and other interests
  • Estimated value and any required independent valuation
  • Income, commitments, credit information and repayment capacity
  • Requested amount, net funds required and proposed use
  • Repayment or exit strategy and contingency if it is delayed

Promises to treat cautiously

  • “Approval based on equity alone”
  • “No credit checks in every case”
  • “No valuation required” without explaining the alternative assessment
  • “Guaranteed settlement” by a fixed deadline
  • “No documents” where identity, purpose and repayment remain unclear
  • Using an ABN or declaration to disguise a personal purpose
Potential leverage

Can a personal-use caveat loan reach 80%–90% LVR?

Up to 80%–90% LVR may be considered only in selected cases by particular providers. It is not a standard limit, entitlement or indication that a specific property or borrower will qualify. Lower limits commonly apply.

The receiving provider decides the value it will accept and how leverage is calculated. Property type, location, marketability, first-mortgage payout, other secured interests, retained interest, fees, legal costs, borrower circumstances, purpose and exit can all reduce the amount available.

Test net funds—not the headline percentage.
A high gross LVR can still produce materially less usable cash after existing debt, retained interest and transaction costs. Ask for a written calculation based on the provider’s accepted valuation.
Cost and property risk

Compare the total obligation—not only the advertised rate.

Ask for a written breakdown showing the gross facility, every deduction, the net amount released and the estimated payout at the intended repayment date. Costs may include interest, establishment or application fees, legal expenses, valuation charges, discharge costs, minimum-interest provisions and default or extension amounts.

If interest is retained upfront, confirm how it affects the funds you actually receive. If the planned exit is a refinance or sale, allow for delays and ask what happens when the loan reaches maturity before the exit occurs.

Your property may be at risk.
Ask an independent solicitor to explain the loan agreement, caveat or mortgage, priority arrangements, enforcement rights and consequences of default. The product label does not replace the contract or applicable law.

Questions to ask before your details or documents go anywhere.

Question Why it matters
Do you accept my exact purpose and borrower structure? Prevents a personal or regulated purpose being incorrectly treated as business lending.
Who is the provider and who makes the credit decision? Clarifies the separate roles of referrer, broker, credit provider and lender.
What checks, documents and valuation process apply? Replaces vague “no doc” or “no valuation” claims with the actual evidence requirements.
How much will I receive after all deductions? Tests whether the facility meets the real funding need after costs and payouts.
What will I owe on my planned exit date? Allows a like-for-like comparison of total cost and repayment obligations.
What happens if the exit is delayed? Shows extension, default and enforcement risks before commitment.
What referral benefit is paid? Ensures the commercial relationship is disclosed before your details are shared.
Frequently asked questions

Caveat loans for personal use in Australia—FAQs.

Can an individual obtain a caveat loan for personal use?

Potentially, but only through a provider that is appropriately licensed or otherwise legally authorised and willing to assess the actual purpose, borrower, security, capacity and exit. Basic Finance does not provide or assess regulated consumer credit; with consent, it may introduce an enquiry to a separate provider for its own assessment.

Does Basic Finance approve personal-purpose caveat loans?

No. Basic Finance may conduct an initial referral-pathway review, but it does not provide, recommend or assess regulated consumer credit. The separate receiving provider decides whether it can consider the enquiry and conducts its own assessment.

Will my information be shared automatically?

No. Basic Finance will seek your consent before sharing contact details with a proposed provider and will disclose any referral benefit or commission before that sharing occurs.

Can I use an ABN to make a personal loan “business purpose”?

No. An ABN or declaration does not change the real use of funds. The predominant purpose and transaction facts must be described honestly and supported by reasonable enquiry and evidence.

Are caveat loans available without credit checks or valuations?

Do not assume that. Requirements differ by provider and transaction. The receiving provider determines which credit checks, documents, property evidence, valuation or alternative assessment it requires.

Can a personal-use caveat loan reach 80%–90% LVR?

Selected providers may consider up to 80%–90% LVR in particular cases, but this is not a standard limit or approval indication. Lower limits commonly apply. The provider’s accepted valuation, existing debt, property, retained interest, fees, purpose, borrower circumstances and repayment exit all affect the result and net funds.

Does a referral guarantee fast settlement?

No. Timing depends on provider assessment, information quality, property evidence, existing mortgage arrangements, legal work, documentation and cleared conditions. No approval or settlement timeframe is guaranteed.

Can residential investment borrowing be regulated?

Yes, certain residential investment borrowing can fall within the National Credit Code when its conditions are met. The receiving provider should determine the applicable pathway from the actual purpose and transaction facts.

What should I do before signing?

Obtain independent legal advice, confirm the total cost and net funds, understand every security and default provision, and test the repayment plan against delays or lower-than-expected sale or refinance proceeds.

A clearer next step

Tell us the real purpose, property and repayment plan.

Basic Finance can review whether an introduction pathway may be available. If appropriate, we will explain the proposed referral, obtain your consent and disclose any referral benefit before sharing contact details.

An enquiry is not an application approval, recommendation, loan offer or commitment to fund. The receiving provider performs its own assessment.
